The Terms

The underlisted terms and conditions governs our relationship with you. We are known as DAILY EXPERT REPORT NETWORK (DERN). We are the first party & we are the principal facilitator or service provider to you the client, (being the second party).

What we do

We facilitate/arrange the procurement of specially written expert report for legal purposes by engaging qualified professionals on your behalf to prepare the expert reports in their field for use by the court, tribunal, immigration or for mediation purposes.

Who Commissions DERF?

We can be commisisoned by private individuals, their solicitors or agents, the Court, Tribunal, Police or other entities.

Service Methodology

Based on the client's requirement, we can select and instruct the most appropriate expert to prepare the required/requested report to the highest standard possible, within legal parameters and in compliance with civil law standards and ethics. Reports procured through us are guaranteed to be of the highest quality & standard. You can be assured that they will be well written, clear to understand, infused with the necessary data and professional references necessary. They are always prepared to meet the required standard of the court, tribunal or mediation entities & protocols. They are written to be understood by their readers and will be clear in content & context for the desired audience(s) to review and apply to the case or matter in hand.

The Experts Defined

Our experts are typically medical doctors, forensic experts (medical & civil), professors & academicians with PhD doctoral qualifications, and who have written many reports & papers in their chosen field. They are very experienced and well versed in their chosen field. They are often one of the best in their field.

Reports Time-line

Time line is typically six to eight weeks or longer is many instances. The more ample the time, the better the outcome. However, our experts are used to working & delivering good quality reports in lesser time frames. Please note that more urgent reports may incur additional cost/expenses.

Instructions:
All instructions shall be provided in writing by the Client. The Expert's acceptance of such instructions (including any variation or further refinement of instructions dealt with in any intervening discussions) shall stand as the instructions unless and until subsequent changes are proposed in writing by the Client.

Multiple Clients?

Where there is more than one Client, the parties and their clients shall be jointly responsible for payment of fees. Our retainder fee is charged per client and is payable from the onset.

Intellectual Rights

Unless otherwise agreed in writing, all legal and beneficial interest in intellectual property rights and rights of ownership in written reports created by the Expert relating to or developed by him/her in connection with the assignment given by the Client shall belong to the Expert. The Expert grants to the Client a non-exclusive, non-transferable license to use the said intellectual property solely in connection with the assignment to which the instructions relate and for the duration of these terms of engagement.

Payment Deadline:

We will require the full fee to be paid immediately upon provision of the report & where agreed, payment must be made within 14 days of the invoice unless otherwise agreed in advance.

What Do You Need From Clients?

We will require all the relevant paperwork & documents relating to the commission and everything available to butress the purpose, use and scope of the requested report.

Client Consent Form:

We will require a signed consent form where we need to arite off to third parties to obtain and document, facts or information on behalf of the client.

Scope Of The Report

The scope of the report will depend on the extent of the commission and the exclusive purpose for which the report is required.

Interpreters

If the assessed person or persons cannot speak English, interpreters shall be provided at the expense of the person requesting the assessment where applicable.

Who We Are Not!
We wish to make clear that we are NOT a law firm!
We are NOT lawyers or solicitors!
We are NOT medical/clinical experts!
We are not military experts!
And we ourselves DO NOT write the Expert reports!
You accept to deal with us knowing that we are mere facilitators of helping you to obtain the report.

OUR FEES

We charge a retainer fee of £250 - £350+ for minimal - standard preparatory work & £450+ for substantial preparatory work for our services depending on the amount or work involved in the commission.

Our retainer fee covers our estimated time for engaging with the commission, talking to client, talking to the experts, coordinating the work, writing off to obtain information/files, from all concerned parties and gather the paperwork involved, including sending emails, faxes, making international phone calls when necessary, providing progress report to the client, ensuring that time lines are adhered to and respected, and ensuring that the reports meets the required legal standard.

DERN RETAINER FEE SCALE

We have two levels of retainer fees payable depending on the commission and the level of work involved for us to carry out as facilitators:
Level 3: Minimal - Medium Level Work Required: £250-350+
Level 4 - Substantial Work Required: £450+

EXPERTS RATE GUIDE:

Travel Time: £55-£75-/Hour
Interview Time: £110-125/Hour
Report Preparation: £110-150/Hour
(Minimum Time Charged is for 10 hours)
Courier Fee/DHL: Variable £35-65
Court Attendance Fee: Full Day- £350-650/Plus Travel
Pro-Bono Work: Rare & Subject To Status

NOTE:
The Expert Fee quoted are only an estimate and may be revised on receipt of letter of instruction, case papers, revised drafts, medical records, etc. Any variation of the fee will be agreed prior to any additional work being undertaken. All rates quoted exclude VAT.

What Does The Expert Fee Cover?

Our experts fee varies and will normally be charged based on the amount of hours invested in the commission. Their fee will often cover, travel time (here applicable), interview time by phone, Skype or in person), research work time, data collation/compilation, report preparation, etc.

Hard Copies By Courier/Cost

Hard copies of the signed report can be sent by courier if requested at cost to the client. Quotes will be provided.

Confidentiality Clause:
All information, discussions, interviews and subsequent records made are kept in the strictest of confidence in accordance with the Data Protection Act. We will not disclose any details in connection with the client except where there is immediate and serious risk to the health or safety of a third party or your client.

First Draft?

Firstdraft of the full report will be provided for clients to examine and add comments or provide further guidance.

Final Draft?

One the amended draft has been completed, it will be delivered and must be promtly paid for. All reports remains the property of the expert until it is paid for in full by the client.

Expert Attending Court?

Typically experts are available to attend the court and give evidence if required at cost to the client. Such cost will be pre-agreed and advance payment is required to cover travel and court attendance time. International experts will cost more to fly in from overseas.

General Data Regulation:
In accepting your instructions, we agree to be data controller jointly with you of the personal data you send us. You agree to respond to any subject access requests or other requests made by data subjects in respect of this information on our behalf as well as your own. If we receive a subject access or other request regarding information you have sent us, we will send it to you to deal with, along with any other personal data we hold as a result of accepting your instructions.

Cancellation Policy

You may cancel any commission within 7 days of the original firm instructions in writing. Any cancellation afterwards will incur not only our the FULL retainer fee of £250 and will also incur a reasonable payment to the Expert for work done since accepting the full commission. This is NOT negotiable, hence clients are advised to only instruct when 100% certain of the commission.

Term Variation

At DERF We reserve the right to vary our terms from time to time without any prior notification. We also cannot accept any variation or modification of these terms unless agreed in advance.
